Terms of Service

1. Agreement Scope & Services

This agreement dictates the framework under which Tenerife Model Agency ("Agency," "we," "us," "our") coordinates professional support, operational strategy, and scaling platforms for content creators ("Creator," "Model," "you," "your").

The services supplied by the Agency include:

• 24/7 Chatting & Account Administration: High-ticket conversion training, pay-per-view optimization, subscriber management, and direct fan chatting conducted by the Agency's sales agents on your behalf.
• Content Production Support: Scheduling, professional photography/videography setups, and high-end set organization utilizing natural volcanic-ocean scenery in Adeje, Tenerife.
• Editing & Post-Production: Quality rendering, brand styling, photo retouching, and premium visual layout compilation.
• Marketing Strategy: Audience growth consulting, conversion funnel mapping, and overall fan engagement planning.

2. Age Requirements & Verification

Due to the adult nature of digital monetization platforms (such as OnlyFans) where our scaling services are active, eligibility is strictly controlled.

• You must be at least 18 years of age (or the age of legal majority in your country of residence, whichever is higher) to qualify.
• You are required to hold and present a valid, unexpired government-issued photo ID for standard platform-level compliance and background verification.
• You warrant that you are legally permitted to enter into this contract and that doing so does not violate any previous arrangements or local laws.

3. Management Splits & Financial Transparency

Tenerife Model Agency prides itself on a fully aligned, commission-only business model. We do not charge any upfront installation or setup fees. We only make money when you make money.

• 65% Creator Earnings Split: You retain a clear, transparent 65% of all gross revenues generated by your contracted profile(s).
• 35% Agency Split: The Agency retains a 35% share of gross revenues. This commission covers 100% of standard operations, including chatter team payroll, photo/video editors, standard equipment depreciation, and software.
• Billing Overhead: We do not send you out-of-pocket bills. The 35% commission covers all basic business infrastructure. Please note that optional paid promotional campaigns or bespoke advertising budgets fall outside this split and are funded separately upon your mutual consent.

4. Intellectual Property & Content Rights

We strongly believe that creators should always maintain absolute authority over their creative output.

• Creator Ownership: You retain 100% complete ownership of all your media, likeness, copyrights, brand equity, and third-party profiles. The Agency will never claim rights or title to your content.
• Limited Operations License: You grant the Agency a non-exclusive, royalty-free, revocable, and limited license to manage, edit, upload, modify (solely for aesthetic optimization), and promote your content on the platforms you designate during the active term of this agreement.
• Reassurance of Safety: This license ceases immediately upon termination of services, and all profile credentials must be returned or updated to protect your security.

5. Representation, Warranties & Safety

As a partner in our elite creator network, you agree to:

• Provide genuine, high-quality, and authentic content according to the agreed calendars.
• Ensure all content you submit is entirely yours, does not infringe on third-party intellectual property or copyright, and is produced in a safe, consensual environment.
• Refrain from publishing or sharing any content that violates third-party platform policies, guidelines, or applicable laws.

6. Month-to-Month Flexibility & Termination

We believe our value is proven through daily execution, not restrictive locks.

• Month-to-Month Basis: Our collaborative relationships operate on a flexible, rolling month-to-month agreement.
• Standard Notice Period: Either you or the Agency can choose to discontinue management services at any point by giving a standard 30-day written notice via email or registered client portals.
• Account Transition: Upon notice, the Agency will coordinate the structured return of all active client panels, spreadsheets, and promotional tracking codes, ensuring a smooth transition with zero disruption to your payout paths.

7. Limitation of Liability & Earnings Disclaimer

While our blueprint is highly optimized (scaling average creators to €30,000+ per month), individual outcomes are inherently tied to creator consistency, market factors, and content quality.

• Disclaimers: The Agency provides scaling advice, chatting, and post-production as-is. We do not guarantee specific monetary milestones or absolute rankings.
• Liability Cap: To the maximum extent permitted by governing laws, Tenerife Model Agency will not be held liable for third-party platform outages, policy changes, sudden account suspensions, or subscriber payment chargebacks.

8. Governing Law & Dispute Resolution

Any disputes, claims, or questions relating to these Terms of Service or our scaling partnership shall be governed by the laws of Spain, under the specific jurisdiction of courts in Santa Cruz de Tenerife, Canary Islands.

Both parties agree to first seek an amicable, informal resolution. If a resolution cannot be reached, the dispute shall be resolved through binding, confidential arbitration, waiving any rights to participate in class-action lawsuits.

9. Amendments & Updates

The Agency reserves the right to make minor modifications to these Terms to reflect legislative changes or operational improvements. In the event of material changes, we will notify you at least 15 days in advance via your registered email.
